TERMS AND CONDITIONS

These terms and conditions apply to all services provided by esimsale inc., hereinafter referred to as eSIMsale, regarding the resale of pre-paid eSIM cards.

The following terms and conditions are available at www.esimsale.com. eSIMsale may change these terms and conditions only with explicit written consent.

1. GENERAL TERMS AND CONDITIONS

These terms and conditions apply to all services provided by esimsale inc., hereinafter referred to as eSIMsale, regarding the resale of pre-paid eSIM cards.

The following terms and conditions are available at www.esimsale.com. eSIMsale may change these terms and conditions only with explicit written consent.

2. DESCRIPTION OF SERVICES

2.1 SALE of eSIM

eSIMsale resells prepaid eSIM cards. The customer registers and purchases eSIM cards at www.esimsale.com and/or in the esimsale app. Payment is made via PAYPAL (https://paypal.com) and credit and debit bank cards.

2.2 REGISTRATION TO USE eSIMsale SERVICES

The client must accept the general terms and conditions to use the eSIMsale services. The client provides directly or through the service provider (hotel, travel agency, etc.) in a web browser on www.eSIMsale.com the following information: Name, surname, address (payment address), e-mail address.

2.3 DUTIES of eSIMsale

eSIMsale will make reasonable efforts to provide quality customer service. Nevertheless, eSIMsale does not guarantee that the operation of the service will be provided on time and without interruption, nor does it guarantee safety and absence of failures.

2.4. CLIENT'S OBLIGATIONS

When using the eSIM provided by eSIMsale, the Client is prohibited from: abusive, illegal and fraudulent actions, as well as actions that lead to deterioration or damage to the Network; if the Client violates the obligations under Section 2.4, eSIMsale may suspend the Client's use of the Service. eSIMsale will notify the Customer of the suspension as soon as possible. During the suspension, Customer shall pay all Payments under this Agreement with respect to the suspended Services.

2.5. DEVICE COMPATIBILITY

It is the Client's responsibility to ensure that the device is eSIM compatible and not tied to a carrier. By checking "Device is compatible with eSIM and not tethered to a carrier" to proceed with the purchase, the Customer is responsible for providing this information. Device compatibility may depend on the service provider and country of origin, therefore the Customer should check the list of eSIM compatible devices, which can be found when placing the order. The eSIM compatibility list is not exhaustive: it may not include recently announced eSIM compatible devices.

3. COMMENCEMENT, DURATION AND TERMINATION OF THE CONTRACT

The eSIM sale agreement between eSIMsale and the Client comes into force after the order is placed on the eSIMsale website https://www.esimsale.com or through the application. It is the Client's responsibility to activate eSIM and comply with the Rules of Activation. If the Client does not have an active traffic package or if the Client has removed the eSIM from the device, the contract will be terminated.

4. PAYMENTS AND CHARGES

4.1. TERMS OF PAYMENT

The cost of eSIM is paid by credit card, through PAYPAL, Google Pay and Apple Pay. The currency of payment is determined by the client's country of registration.

4.2. PAYMENTS FOR USE

4.2.1 All Payments for eSIMsale services shall be inclusive of VAT, unless otherwise stated.
4.2.2. The Customer shall not have the right to set off his claims against eSIMsale, unless the Customer's claims are uncontested or confirmed by a final court decision.

5. DELIVERY

The Client will immediately see the purchased eSIM in the "My eSIM" tab on the website and/or app. After the purchase, the Client will receive a confirmation email. All eSIM installation information will be presented only in the eSIMsale user account.

6. REFUND, CANCELLATION AND ADJUSTMENT POLICY

If the eSIM cannot be installed and used due to a technical problem on the part of eSIMsale, the Customer has the right to request a refund or adjustment.

6.1. REFUND AND CANCELLATION

6.1.1. POLICY AND RECOMMENDATIONS

6.1.1.1. A refund request can be made within thirty (30) days from the date of purchase, but only if, after careful troubleshooting, activation still appears to be impossible.

6.1.1.2. If an eSIM is already in use and a problem arises on the eSIMsale side that cannot be resolved in a timely manner, funds for the remaining traffic may be refunded.

6.1.1.3 The Client's cooperation is essential for the quickest resolution of the problem, otherwise a refund may not be possible.

6.1.1.4 Traffic packages have an expiration date. Upon expiration, no refunds for remaining traffic are provided in any form.

6.1.1.5. Compensation. Refunds and any kind of compensation shall not be granted in respect of payments for other phones, other SIM cards, hotel phones and other payments which are not directly linked to the Customer's eSIM account. (See section 7. LIABILITY AND WARRANTIES in the Terms and Conditions.)

6.1.1.6. Fraudulent Purchase. eSIMsale reserves the right to refuse any refund if there is evidence of abuse, violation of our terms and conditions or evidence of other fraudulent activity related to the use of eSIMsale products and services.

6.1.1.7. Unauthorized purchase. Such cases will be investigated and verified prior to refunds. eSIMsale reserves the right to suspend an account associated with fraudulent activities of any kind.

6.1.1.9. Incorrect charges. If the Customer reasonably and in good faith disputes an invoice or part thereof, the Customer shall notify eSIMsale of such dispute within 12 days of receiving the invoice and provide detailed information as to why the amount invoiced is incorrect and, if possible, what the amount should be in the Customer's opinion. (See section 4.2 PAYMENTS FOR USE in the Terms and Conditions for details.)

6.1.1.10. Other reasons. If a refund request does not meet the above items, we will review it on an individual basis. If the refund is approved, a processing fee may be charged. The maximum amount of credit available for a refund that the Client may apply for must be equal to or less than the total amount paid by the Client.

6.1.2. REFUND PROCESS

To request a refund, contact eSIMsale support from the Contact Us page or send an email to support@eSIMsale.com. Keep in mind that our refund policy described above will apply. Depending on the nature of the problem, customers will be asked for additional information to justify the refund request such as screenshots of the device settings (in case of technical problems) or information about why the billed amount is incorrect and, if possible, what the amount should be in the customer's opinion. See section 6.1.2 of this document for information about refunds due to technical problems. Customers will have the option to return funds to the original method of payment (credit card or PayPal). Refunds to original method of payment: Once a refund is approved and implemented, it may take 5-10 business days for it to appear on the statement - depending on the bank.

6.2. Package Modification

eSIM traffic packages from eSIMsale are offered as is. After purchase, adjustments and modifications on an individual request are not possible.

7. LIABILITY AND WARRANTY

eSIMsale is not liable for damages caused by the fact that the service offered is not available or is not constantly available. eSIMsale does not guarantee the continuous availability of the network service. If you have any questions, email support@esimsale.com.
